Liquor, Gambling and Adult Entertainment Licensing

Licensing Act 2003

Legislation introduced to transfer from the Magistrates to the Council the issue and control of liquor licences. Principle areas are the sale of alcohol, sale of late night refreshment (service of hot food between 23.00 hours to 05.00 hours), regulated entertainment and club premises.

The registers for premises, clubs, personals are those licences issued since 24 November 2005. The TEN (temporary event notices) register shows only events since 1 January 2008.

Premises or club premises currently under review:



Premises Licence
- Issued to any premises that are open to the public for the sale of alcohol, late night refreshment and regulated entertainment. You can download the required application form and supporting documentation below:


Club Premises Licence - Issued to private members clubs, for late night refreshment and regulated entertainment. For the benefit of the Licensing Act 2003, private members clubs do not sell alcohol. You can download the application form and supporting documentation below:


Personal Licence - Issued to any suitably qualified person over 18 years of age and enables that person to sell or authorise the sale of alcohol. A basic disclosure is required on application and is currently only available from the Criminal Records Bureau in Scotland, where you can apply online. Temporary Event Notice (TEN) - Issued in order to facilitate the sale of alcohol, regulated entertainment or late night refreshment, for occasional events. A Personal Licence Holder may apply for 50 TEN's per annum and a non-Personal Licence Holder may apply for 5 per annum. Premises can have 12 TEN's per annum, to a maximum of 15 days. Gambling Act 2005

New legislation gives responsibility to Licensing Authorities (local Councils) to undertake a number of licensing and regulatory functions in relation to gambling premises. In all their activities the authorities will be guided by the licensing objectives, which are:

  1. To prevent gambling being a source of crime and disorder, being associated with crime and disorder, and being used to support crime.
  2. To ensure that gambling is conducted in a fair and open way.
  3. To protect children and other vulnerable persons from being harmed by gambling.

North Norfolk District Council has produced a gambling policy (PDF, 285KB). The transition period for the transfer to local authorities ended in September 2007. The register for gambling premises issued since 1 September 2007 only contains the minimum required information.


Lotteries - Small Society

Registration required by promoters of societies' lotteries - selling draw tickets to the public but excluding raffles at particular events. Lottery registration continues for life until cancelled. However an annual fee is payable to maintain registration. Sex Establishments

Sex establishments are required to be licensed under the Local Government (Miscellaneous Provisions) Act 1982. A sex establishment can be either a Sex Shop or Sex Cinema. A Sex Shop is a premises used for business which consists to a significant degree of selling sex articles. A sex cinema is any premises used to a significant degree for showing of films which are concerned primarily with, or relate to, or are intended to simulate sexual activity.

The law defines the way in which an application is made, which include advertising notice of the application in the local press and displaying a notice outside the premises for a specific time period to give passersby the opportunity to comment by a statutory closing date. When considering an application for a licence the Council may only use the following criteria:

  • the suitability of the applicant;
  • whether the person applying is a "front" person for someone else;
  • the location and situation of the premises in relation to other premises in the area;
  • whether the number of sex establishments in that locality is equal to, or exceeds the number which the Council considers appropriate for the area.
