Local Authority Pollution Prevention and Control The Pollution Prevention and Control Act 1999 The Pollution Prevention and Control (England and Wales)
- Introduction
The operators of specified polluting industrial installations are, under the new Local Authority Pollution Prevention and Control (LAPPC) scheme, required, by law, to obtain a permit in order to operate.
Local Authority Pollution Prevention Control (LAPPC), or Part B installations, are concerned with controlling the environmental impact arising from emissions to air from installations which are listed in Part B of Schedule 1 to the PPC Regulations.
Larger polluting processes, known as A2 installations, are also regulated by the Local Authority under the Local Authority Integrated Pollution Prevention Control (LA-IPPC) regime. This regime determines the appropriate controls for industry to protect the environment but is not just limited to emissions to air, but also includes protection of land and water (including discharges to sewers) plus any other activities that have an environmental impact.
Large pollution processes are controlled by the Environment Agency and these are known as A1 installations under the Integrated Pollution Prevention Control (IPPC) regime.
The Integrated Pollution Prevention Control (IPPC) and Pollution Prevention Control (PPC) systems are the means by which the Government has implemented the EU Integrated Pollution Prevention Control Directive (96/61/EC).
In order to taid the applicant with what is required by a Permit, DEFRA have issued Process Guidance Notes for each prescribed industrial process. These Notes can be found on the DEFRA website detailed in the link below, or purchased from HMSO. Permit conditions are drafted in accordance with these Process Giudance Notes but must also be based on the use of BAT (Best Available Technique) which balances the cost to the operator against the benefits to the environment.
The table in the link below presents prescribed industrial processes that are currently regulated by the Local Authority and hence, require permitting. The link to DEFRA's Process Guidance Notes is also given.
